These Terms of Service ("Terms") govern your access to and use of kylercoded.com, our client portal, and any services provided by Kyler Coded ("we," "us," or "our"). By using our website, engaging our services, or accessing our client portal, you agree to these Terms.

1. Acceptance of Terms

By visiting our website, booking a discovery call, signing a proposal, or otherwise engaging Kyler Coded's services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Services

Kyler Coded provides AI automation consulting and development services, including but not limited to workflow audits, custom automation builds, and ongoing support retainers. The specific scope, deliverables, timeline, and pricing for any engagement are defined separately in a proposal or agreement between Kyler Coded and the client.

3. Client Responsibilities

To deliver our services effectively, we rely on clients to provide timely, accurate information about their existing workflows, tools, and business processes. Delays in providing necessary access, information, or feedback may affect project timelines. Clients are responsible for maintaining the confidentiality of any login credentials issued for the client portal.

4. Fees and Payment

Fees for services are outlined in the applicable proposal or invoice. Payment terms, including due dates and accepted methods, will be specified at the time of engagement. Late or missing payment may result in a pause of active work until resolved.

5. SMS and Text Messaging

If you provide your phone number and opt in to receive text messages from Kyler Coded, you may receive messages related to appointment reminders, project updates, and account notifications.

• Message and data rates may apply.
• You can opt out of text messages at any time by replying STOP. You can request help at any time by replying HELP.
• We do not sell, rent, or share your mobile phone number or SMS opt-in information with third parties for their marketing purposes.

6. Intellectual Property

Unless otherwise agreed in writing, custom automation systems, workflows, and documentation built for a client become the client's property upon full payment. Kyler Coded retains the right to reuse general methods, frameworks, and non-client-specific know-how developed during an engagement.

7. Confidentiality

We treat client business information, client data, and account access shared with us as confidential, and we will not disclose it to third parties except as necessary to deliver our services or as required by law.

8. Limitation of Liability

Kyler Coded provides services on an "as available" basis. To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of our services or the client portal. Our total liability for any claim will not exceed the amount paid by the client for the specific engagement giving rise to the claim.

9. Termination

Either party may terminate an active engagement in accordance with the terms outlined in the applicable proposal or agreement. Kyler Coded reserves the right to suspend access to the client portal for accounts with outstanding payment issues or violations of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
